Hemp and CBD

With the 2017 launch of Wisconsin’s Industrial Hemp Pilot Program and now the passage of the Federal 2018 Farm Bill, this is a quickly emerging industry within the state of Wisconsin, providing vast market opportunities for Midwest farmers, hemp processors, wholesalers and retailers. Yet many challenges remain, including the high level of government oversight, difficulties in finding traditional financing, and, for service providers, conflicting laws and regulations and lack of clear guidance in serving industry participants.

Boardman Clark’s Hemp & CBD Practice Group is comprised of attorneys with corporate, real estate, banking, agri-business, intellectual property and finance experience who understand the evolving legal landscape and unique challenges faced by the hemp and CBD industry. We can advise direct industry participants on all areas of this regulated business, from financing and formation to operation and compliance. For banks and other service providers, we can help you understand how your own governing laws interact with those of the hemp and CBD industry. We can also provide practical considerations to help you serve this growing industry.

We support a variety of clients in this space, such as:

  • Assisting a hemp grower and processor to form an LLC and raise $2.5M to launch operations

  • Working with Wisconsin banks to help find a path to offer traditional banking services to the industry

  • Serving as intellectual property counsel to companies that manufacture vaporizers, aromatizers and grow lights

  • Serving as business counsel to a CBD retail operation

  • Serving as counsel to a financing entity serving the hemp and CBD markets
